1. Introduction
Welcome to BagTag ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the BagTag mobile application and related services (collectively, the "Service"). BagTag is a social platform for discovering, reviewing, and sharing golf courses. By using our Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. Acceptance of Terms
By downloading, installing, accessing, or using the BagTag app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and BagTag. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Eligibility
BagTag is available to users of all ages (4+). By using the Service, you represent and warrant that: • You have the legal capacity to enter into these Terms, or have parental/guardian consent • You are not prohibited from using the Service under applicable law • Your use of the Service does not violate any applicable law or regulation If you are under 18, your parent or legal guardian must review and agree to these Terms on your behalf. If you are under 13, a parent or guardian must provide consent and supervise your use of the app.
4. Account Registration
To access certain features, you must create an account. When registering, you agree to: • Provide accurate, current, and complete information • Maintain and update your information as needed • Keep your login credentials secure and confidential • Notify us immediately of any unauthorized access • Accept responsibility for all activities under your account We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.
5. User Content
Content You Submit
You may submit content including reviews, ratings, comments, photos, and videos ("User Content"). You retain ownership of your User Content, but by submitting it, you grant BagTag a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with the Service.
Content Responsibility
You are solely responsible for your User Content. You represent and warrant that: • You own or have the necessary rights to submit the content • Your content does not infringe any third-party rights • Your content complies with these Terms and applicable laws
Content Removal
We reserve the right to remove or modify any User Content that violates these Terms or is otherwise objectionable, without prior notice.
6. Acceptable Use Policy
You agree not to use the Service to: • Violate any applicable law or regulation • Infringe on intellectual property or other rights of others • Post false, misleading, defamatory, or fraudulent content • Harass, bully, threaten, or intimidate other users • Post hateful, discriminatory, or offensive content • Share sexually explicit or violent material • Spam, advertise, or solicit without authorization • Impersonate any person or entity • Collect user information without consent • Interfere with or disrupt the Service • Attempt to gain unauthorized access to the Service • Use automated means to access the Service without permission • Reverse engineer or attempt to extract source code
7. Social Features
BagTag includes social features that allow you to interact with other users:
Following and Followers
You can follow other users and be followed. Your followers list and following list may be visible to other users unless your profile is hidden.
Direct Messaging
Direct messaging is available between users who mutually follow each other. Messages are private between participants. You agree not to use messaging for spam, harassment, or any prohibited purpose.
Blocking
You can block other users at any time. Blocking will hide your profile, content, and all interactions from the blocked user, and vice versa. Past interactions will also be hidden.
Profile Visibility
You can control your profile visibility in settings. When hidden, your profile and content are not visible to other users.
8. Content Moderation and Reporting
We strive to maintain a safe and respectful community: • You can report users or content that violates these Terms • We review reports and may take action including content removal or account suspension • We are not obligated to monitor all content but reserve the right to do so • Repeated violations may result in permanent account termination • False or abusive reporting may result in action against your account We appreciate your help in keeping BagTag a positive community for all golfers.
9. Intellectual Property
Our Intellectual Property
The Service, including its design, features, content, and trademarks, is owned by BagTag and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without compensation or attribution to you.
Copyright Complaints
If you believe content on BagTag infringes your copyright, please contact us with details of the alleged infringement. We will respond to valid notices in accordance with applicable law.
10. Third-Party Services
The Service may integrate with or link to third-party services: • Google Sign-In and Apple Sign-In for authentication • Google Maps for location features • Other services for functionality and analytics Your use of third-party services is subject to their own terms and privacy policies. We are not responsible for third-party services or content.
11. Golf Course Information
BagTag provides information about golf courses, including ratings, reviews, and details submitted by users and other sources: • We do not guarantee the accuracy, completeness, or currency of course information • Course conditions, availability, and policies may change without notice • User reviews and ratings reflect individual opinions • Always verify information directly with golf courses before visiting BagTag is not affiliated with any golf course unless explicitly stated.
12. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you agree to our Privacy Policy.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING: • MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE • NON-INFRINGEMENT • ACCURACY OR RELIABILITY OF CONTENT • UNINTERRUPTED OR ERROR-FREE OPERATION • SECURITY OF THE SERVICE Your use of the Service is at your own risk.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAGTAG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR: • Indirect, incidental, special, consequential, or punitive damages • Loss of profits, data, or goodwill • Service interruption or system failure • Content submitted by users • Any third-party conduct or content Our total liability shall not exceed the amount you paid us in the past 12 months, or $100 if you have not made any payments.
15. Indemnification
You agree to indemnify, defend, and hold harmless BagTag and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: • Your use of the Service • Your User Content • Your violation of these Terms • Your violation of any rights of another party
16. Termination
Termination by You
You may stop using the Service at any time. You can delete your account through the app settings (Settings → Privacy). Account deletion will remove your profile and associated data.
Termination by Us
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for: • Violation of these Terms • Conduct harmful to other users or the Service • Fraudulent or illegal activity • Extended periods of inactivity
Effect of Termination
Upon termination, your right to use the Service ends. Provisions that should survive termination (such as intellectual property, disclaimers, and limitation of liability) will remain in effect.
17. Dispute Resolution
If you have a dispute with BagTag: • Contact us first to attempt informal resolution • Most disputes can be resolved through our support team • These Terms are governed by applicable law • You agree to resolve disputes individually, not as part of a class action We encourage you to reach out to us before pursuing formal legal action.
18. Changes to Terms
We may update these Terms from time to time. When we make changes: • We will update the "Last Updated" date • We will notify users of material changes through the app • Continued use of the Service constitutes acceptance of the updated Terms We encourage you to review these Terms periodically.
19. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BagTag regarding the Service.
Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.
Waiver
Our failure to enforce any provision does not constitute a waiver of our right to enforce it later.
Assignment
You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor.
